Congratulations to William Bay on his win against Ahpra and the Medical Board of Australia.

This now makes for very interesting times indeed on the voluntary informed consent for vaccination front, and practitioners' legal, ethical and moral obligation to uphold this vital principle.

This development opens up a whole can of worms - for Ahpra and the Medical Board, for the practitioners, and for other institutions which have collaborated with the destruction of voluntary informed consent for vaccination.

Elizabeth you are probably aware that during the Melissa McCann case in the Federal Court on 5th December, the barrister for TGA said that the TGA has no duty of care to Australians. The barrister added that the duty of care is with the person holding the needle. And of course informed consent was never given. Interesting times indeed, whilst we watch the Australian Government passing the buck on to the unwitting Pharmacists and Doctors. The herd mentality of those injectors, who think that because everyone is doing it means they are safe, is going to prove to have been a dangerous assumption.

Hi again Rosemary, I've looked through the Outline of Submissions prepared by Emma Gill, but I can't find reference to "the duty of care is with the person holding the needle".

So was this something said during the proceeding of the court?

Hello again Elizabeth, I have responded to you on the other thread but for good order and others, I will do so again here. I am anxious not to mislead or misinform anyone on this. I am now doubting my recollection of the moment the barrister said that the TGA has no duty of care. At that moment in conversation with the person next to me we confirmed that it meant the duty of care rested with the administrator of the injection, and fear that I have misconstrued that it was actually said by the barrister that the administrator of the vaccine is liable. I have heard from another party that she didn’t remember hearing this from the barrister, so I fear I have been in error. I will look into it further but apologise for misleading you. Rosie

Don't worry, but it's interesting it crossed your mind, because I think this is actually the case - the person administering the needle DOES have the duty of care, and the legal, ethical and moral obligation to obtain voluntary informed consent for this medical intervention.

So don't worry any more about it.

As you note in your discussion with William, Ahmad, Anne Tonkin has now stepped down as Chair of the Medical Board of Australia. Ahpra CEO Martin Fletcher also announced his departure in August 2024, term ending in December 2024.

I have written to Anne Tonkin and Martin Fletcher and the professional medical organisations many times, pleading for voluntary informed consent to be upheld.

We are absolutely euphoric over this. It bodes well for My-Le Trinh too. How can they accuse her of substandard treatment now, or ever? She saved Patient A’s life, and the tribunal has persecuted her. Now that Dr. Bay is vindicated, she must be too.

WOW what an amazing person! William was definitely born to fight in our war to defeat Evil, I am glad he answered to his call to become a doctor later in life, it was definitely meant to be. It's a shame his wife didn't see it, maybe one day she will..

Great interview, great victory!!! No shame in being an uber driver either, my husband who was a certified Gas and Water engineer now finds himself doing Uber after being left with nothing following a massive accident at work resulting in a metal rod and bolts in his leg and ankle. His employers have accepted 100% liability for his accident but are using the excuse not to pay him compensation due to him testing positive for the Huntingtons gene. They are currently arguing that the loss of future earnings shouldn't be until retirement age because statistically he should be dead. Uber has saved us from bankruptcy along with me going back into front line management within children's safeguarding working 60 plus hrs a week. What really pisses me off is that we've been fighting compensation for the past 5 years and during covid we were told he wasn't classed as an emergency and was left for 18mths with a broken leg needing surgery to take bone from his hip and implant into his leg. Sorry, rant over, well done on your hard battle William what doesn't kill us certainly makes us stronger 💪

Oh Kerry this is such a difficult read. I'm so sorry you and your husband have had to go through this. I can't help but get angry at the medical and insurance world who have clearly failed him. Btw didn't mean anything disparaging about user drivers, it's just such a waste of a good doctors training and skills such as Billy's to be denied his ability to work.
